Paris - Most French See Islam Too Influential In Society: Poll ...

Paris - An increasing majority of people in France believe Islam plays too influential a role in their society and almost half see Muslims as a threat to their national identity, according to a poll published on Thursday.

The survey by pollster Ifop in Le Figaro newspaper showed that 60 percent of people believed that Islam was ?too important? in France in terms of its influence and visibility, up from 55 percent two years ago.

It found that 43 percent of respondents considered the presence of the Muslim community as a threat to their national identity, compared with just 17 percent who said it enriched society. Forty percent of those questioned were indifferent to the presence of Islam, Le Figaro said.

?Our poll shows a further hardening in French people?s opinions,? Jerome Fourquet, head of Ifop?s opinion department, told the newspaper.

The struggle of secular France, whose people are mainly Catholic, to assimilate the largest Islamic population in Europe was thrust into the spotlight in March when Muslim Mohamed Merah, went on a shooting spree in southwest France that killed three Jewish children, a rabbi and three soldiers.

?In recent years, there has not been a week when Islam has not been in the heart of the news for social reasons: the veil, halal food, for dramatic news like terrorist attacks or geopolitical reasons,? Fourquet said.

The prevalence of halal food and rising immigration - particularly from Islamic north Africa - were hot topics in the campaign for the presidential election as Nicolas Sarkozy sought to appeal to voters of the far-right National Front.

Sarkozy eventually lost to Socialist Francois Hollande but a contender to lead his conservative UMP party, Jean Francois Cope, put Islam back on the agenda this month by suggesting Muslim youths were tearing pain au chocolat pastries from children?s hands during Islam?s fasting month of Ramadan.

The publication of the poll also came after a far-right group occupied a mosque in the western city of Poitiers at the weekend and issued a ?declaration of war? against what it called the Islamisation of France.

Mohammed Moussaoui, president of the French Muslim Council (CFCM), said fear of Islam was being stoked by political manipulation of concern over immigration and fears the growing Muslim population could lead to the imposition of sharia law.

?Islam has left the spiritual sphere to become a political subject,? he said, in response to the poll. ?Attempts to associate marginal practices with mainstream Muslim religion fuels the rejection of every aspect of Islam.?

The survey, carried out on October 15-18 on 1,736 people, showed a growing resistance to the symbols of the Islamic faith. Some 43 percent of those questioned were opposed to more mosque building, up from 39 percent in 2010.

Sixty-three percent opposed Muslim women wearing the veil or Islamic headscarves in public, compared with 59 percent two years ago. Sarkozy?s previous conservative banned the wearing of full-face veils.

FTC helps slow tech support scam; don't give remote computer access

?Oh, I think I?ve done something horrible,? the woman?s voice spoke quickly and somewhat wavering. ?I think I?ve lost control of my computer, and I don?t know what to do.?

Without stopping, she continued to describe how there was a ?wicked? virus on her home computer and that Microsoft Tech Support had contacted her to say they needed to fix her computer.

When she took a breath, I asked if they were in her computer at this time.

?Why, yes! I don?t want this virus to take over my entire computer,? she says.

In spite of the major efforts to close down the tech support scam, calls continue to plague unsuspecting Snake River Region computer owners.?In the end, the con artists charge hundreds of dollars to remotely access and ?fix? the computers.

After calming her down, explaining the scam, I had her simply unplug the computer, call a trusted computer repair shop, and take no further calls from the phone number.

On Oct. 4,?the Federal Trade Commission cracked a major international tech support scam?in which telemarketers masquerade as major computer companies, con consumers into believing their computers are riddled with viruses, spyware and other malware, and then charge hundreds of dollars to remotely access and ?fix? the consumers? computers.

The FTC charged that the five operations ? mostly based in India ? target English-speaking consumers in the United States, Canada, Australia, Ireland, New Zealand and the U.K. from telemarketing boiler rooms.

Telemarketers claimed affiliation with Dell, Microsoft, McAfee and Norton, and told intended victims malware was detected by the company and needed immediate removal. The scammers direct consumers to a?utility area of their computer?to show that the computer had been infected. ?The scammers charge from $49 to $450 to remove it.? When consumers agreed to pay the fee, the scammers took remote access to the victim?s ?computer to ?remove? non-existent malware and downloaded otherwise free programs.

A sixth company lured computer owners through Google ads that appeared when consumers searched for their computer company?s tech support telephone number.

When in operation, FTC claims, tens of thousands of people were tricked into paying removal fees that are ?standard warnings and errors?generated by software companies, and are not viruses.

Stimulating brain cells with light

ScienceDaily (Oct. 26, 2012) ? Introducing a light-sensitive protein in transgenic nerve cells ... transplanting nerve cells into the brains of laboratory animals ... inserting an optic fibre in the brain and using it to light up the nerve cells and stimulate them into releasing more dopamine to combat Parkinson's disease. These things may sound like science fiction, but they are soon to become a reality in a research laboratory at Lund University in Sweden.

For the time being, this is basic research but the long term objective is to find new ways of treating Parkinson's disease. This increasingly common disease is caused by degeneration of the brain cells producing signal substance dopamine.

Many experiments have been conducted on both animals and humans, transplanting healthy nerve cells to make up for the lack of dopamine, but it is difficult to study what happens to the transplant.

"We don't know how the new nerve cells behave once they have been transplanted into the brain. Do they connect to the surrounding cells as they should, and can they function normally and produce dopamine as they should? Can we use light to reinforce dopamine production? These are the issues we want to investigate with optogenetics," says Professor Merab Kokaia.

Optogenetics allows scientists to control certain cells in the brain using light, leaving other cells unaffected. In order to do this, the relevant cells are equipped with genes for a special light-sensitive protein. The protein makes the cells react when they are illuminated with light from a thin optic fibre which is also implanted in the brain. The cells can then be "switched on" when they are illuminated.

"If we get signals as a response to light from the host brain, we know that they come from the transplanted cells since they are the only ones to carry the light-sensitive protein. This gives us a much more specific way of studying the brain's reactions than inserting an electrode, which is the current method. With an electrode, we do not know whether the electric signals that are detected come from "new" or "old" brain cells," explains Merab Kokaia.

The work will be conducted on laboratory rats modelling Parkinson's disease. The transplanted cells will be derived from skin from an adult human and will have been "reprogrammed" as nerve cells. Merab Kokaia will be collaborating with neuro-researchers Malin Parmar and Olle Lindvall on the project. The three Lund researchers have received a grant of USD 75 000 from the Michael J. Fox Foundation, started by actor Michael J. Fox and dedicated to Parkinson's research.

The light-sensitive protein is obtained from a bacterium, which uses light to gain energy. Since it is not a human protein, the safety checks will be extra strict if the method is to be used on humans.

"We know that this is long term research. But the methodology is interesting and it will be exciting to see what we can come up with," says Merab Kokaia.

After spending two years trying unsuccessfully to legalize online poker, a group that included an Inland casino-owning tribe, has dissolved.

Tribes, including Inland tribes, were not united behind the effort to legalize online poker ? a factor that certainly didn?t make the failed attempt any easier.

From the San Manuel Band of Mission Indians: Effective October 12, 2012, the San Manuel Band of Mission Indians has withdrawn from the 29 tribe California Tribal Intrastate Poker Consortium, LLC, which was formed in 2009 to further the interests of California tribes in intrastate Internet poker. The consortium is one of two members of the California Online Poker Association (COPA). The other member is a consortium of major
California card rooms. San Manuel?s withdrawal from the tribal consortium automatically removes it as one of that organization?s delegates on the COPA board.

?Our tribe?s withdrawal was made after careful deliberation and with the greatest of respect for, and gratitude to, our tribal co-members in the consortium,? said San Manuel Band of Mission Indians
Chairperson Carla Rodriguez. ?Our collective effort was a meaningful step toward bringing the benefits of intrastate Internet poker that is safe and well-regulated to the public, the state government, and the
gaming industry in California. We look forward to continuing the cooperative efforts in the future.?

San Manuel?s decision to withdraw was based, she said, on the realization that, ?The politics over Internet poker over the last two years simply has not caught up with modern technology?s inroads into California gaming economics, and it was unclear how soon in the future that would change. We decided it was time to step back for awhile and assess the situation.?

From Ryan Hightower, the association?s spokesperson: ?The California Online Poker Association?s Board of Managers has announced it is dissolving the association. The decision was based upon insufficient progress within the legislature toward the passage of an online poker [sic] bill.

When the California Online Poker Association (COPA) was formed two years ago, the COPA operating agreement contemplated that the organization might be dissolved if state online poker legislation had not passed by January 2, 2013.

COPA?s members continue to believe that the authorization of intrastate Internet poker would provide California with hundreds of millions in new state revenue, thousands of new jobs and vital protections for players.?

The newly discovered insect tucks its head into its throat - making it not only a new species but an entirely new genus, or larger classification of plants and animals.

Ross Winton captured the insect in 2009 in traps he set in a sand dune while an entomology graduate student at Montana State University. Winton, now a wildlife technician in Idaho, at first thought he had parts of an ant but then discovered the bug can hide its head, much like a turtle ducking into its shell.

Winton sent his discovery to scientists in Australia working on this group of insects and the headless ladybug was formally described in a recent issue of the peer-reviewed journal Systematic Entomology, a publication of the Royal Entomological Society.

Just two specimens of the tan, pinhead-sized ladybugs, also known as ladybird beetles, have ever been collected, a male in Montana and a female in Idaho, scientists said, making it the rarest species in the United States.

Entomologists historically used males to describe beetle species so the credit for the new discovery went to Winton.

However, the new species - Allenius iviei - was named after his former professor and Montana State University entomologist Michael Ivie.

The insect, with the proposed common name "Winton's Ladybird Beetle," may prey on aphids and other plant pests.

"The species is very unusual not only because of its small size, unique habitat and rarity, but the fact that its head is pulled back into a tube in its thorax makes its biology quite a mystery," Ivie told Montana State University News Service.. "It was so unique that it was placed, along with another new species known from Baja California, in a new genus. While discovery of a new species of beetle in the USA is not an everyday event, a completely new genus is quite rare."

He said it was unclear why the beetle slips its head into a tube in its midsection.
"It's a whole new kind of ladybug. Whatever this does, it is very specialized. It's quite the exciting little beast," Ivie said.

{SLOW COOKER}VEGETABLE BREAKFAST CASSEROLE?

1 lb. bacon, sausage, or ham (cooked & chopped)

1 sm. onion, diced

1 sm. bell pepper, diced

3 green onions, chopped

Half a 32 oz. bag of frozen hash browns

(I suggest using the cubed hash browns as they will hold their shape better after overnight cooking)

1 and 1/2 c. shredded cheese?

(I mixed cojack along with 2% fiesta cheese)

6 eggs

(or 4 eggs and 4 egg whites)

1/2 c. (1%) milk (I used just a tad more)

Salt and Pepper, to taste

Spray slow cooker with cooking spray or place a liner inside.

?Layer the ingredients as follows - hash browns, meat, onions, bell pepper, and?

1 cup cheese ?

?In a bowl, mix together the eggs, milk, salt, and pepper.

?Pour egg mixture over ingredients in slow cooker. ?

?Spread the remaining cheese on top.

?Cook on low for 7 hours overnight.

(I recently purchased an electronic timer (about $5) and set it to?turn off about an hour before I wake up...I think that's?better than having it start after you go to bed as you don't want the eggs to sit out without cooking).?

Sandoval's historic night lifts Giants to win in Series opener

SAN FRANCISCO ? Deep into the autumn night the baseballs climbed, three white streaks soaring to the AT&T Park bleachers. Each time Pablo Sandoval dropped his bat and watched history fly. Three home runs the San Francisco Giants' third baseman hit in Game 1 of the World Series, something done only three other times in a World Series game.

And so Sandoval jogged around the bases Wednesday night as 42,855 fans chanted his name in an improbable 8-3 rout of the Detroit Tigers that was stunning in the fact Sandoval and the Giants pounded Tigers pitcher Justin Verlander, who is widely considered the best pitcher in baseball. In fact the pounding of Verlander was so complete ? six hits and five runs in just four innings ? he was gone by the fifth inning.

"Just going up against Verlander, I was coming out here expecting a game that was going to be 1?0, 2?0," Giants starter Barry Zito said.

By the time Verlander exited, the game was out of hand, lost in a haze of events as freakish and unimaginable as Sandoval's record home runs. There was Zito, whose once-brilliant career had stumbled in recent years, slicing through the Detroit lineup with looping curveballs the Tigers could not touch. And even when the Tigers attempted to crawl back into a game it seemed stunned to be losing, crazy things kept getting in the way, like the ground ball struck by the Tigers' Delmon Young in the fourth inning against Zito. The ball appeared to hit in foul territory ? Young seemed to think it did ? but was snatched up by catcher Buster Posey who quickly tagged Young and fired to second for a double play that killed the rally.

Amazing too were the two diving catches by Giants left fielder Grego Blanco that stifled Detroit chances in the third and sixth. And who could explain the ground ball that the Giants' Angel Pagan hit in the third that struck third base and rolled into left field for a double? Tigers third baseman Miguel Cabrera could only throw back his head and roll his eyes in frustration.

Two batters later Sandoval hit the second of his three home runs and the rout was on.

"Man, I still can't believe it," Sandoval said of his performance. "When you're a little kid, you dream of being in the World Series, but I was thinking of being in this situation, three homers in one game."?

In the end, the night was Sandoval's. The only other men to hit three home runs in a World Series game are Babe Ruth who did it in 1926 and 1928, Reggie Jackson in 1977 and Albert Pujols last year. He finished the night with four hits in four at bats and 13 total bases.

He now has six home runs in the postseason. And the bat he used to club three of them Wednesday night is off to one of baseball's holiest places.

"The guy from Cooperstown [took] it," Sandoval said.

Given the way the Giants hit Verlander, the seemingly indomitable Tigers suddenly look a lot less intimidating.

The payment pioneer clearly isn't content to isolate itself or anyone else, as it's making its international debut with support for Canada. Locals can immediately request the free Mobile Card Reader and swipe credit cards with an Android or iOS device at the same flat, 2.75 percent rate that more experimental American stores know very well. Complete equality isn't available to Canucks just yet, as Square Wallet won't be available until 2013, but the access remains a step forward for Canadian merchants that don't want to be tied down to a terminal any more than their southern neighbors.

Not quite a year ago (that's my brother Dave, who spent the night here Tuesday, on business), and I still have some in the freezer. This is the very last of the steaks?it's ground meat and sausage from here out. I've done sous vide and a few other ways, but I'm using the last of the steaks for Massaman Curry. He's headed to Montana next week, and so hopefully I'll be replenished.

First, you need massaman curry paste. I get mine from local Asian markets, like 99 Ranch. But what the hell, Matt Stone makes his own and that's a value you can tap into no matter what. Or, you can get it online, and that product is basically the same as I get at the market.

I've blogged about numerous massaman dishes over the years?it being about my favorite taste in the world?but this is the first time I've done it in a crock pot. I have, in the past, added a dollop of massaman paste to something like a pot roast just to get un certain je' ne sais quoi sort of deal, but this is full blown. After you have secured the curry paste, you need meat. While this is wild elk, you can also use beef, lamb, probably even goat.

You're best off browning it and my preferred method of browning is with ghee, lard / bacon drippings, or coconut oil in a wok, which facilitates tossing, so you don't have to turn.

Works great; no mess, done in a couple of minutes.

OK, so never having done it this way, I was looking primarily for meat that's spoon tender. Beatrice and I go to Thai restaurants now and then and massaman beef is almost always one of the dishes we have. We are very, very particular about the tenderness of the meat and if we get a tough batch?no matter how tasty the sauce?we won't be back.

So to make sure the meat is going to be very tender, the crock pot is ideal. The browned meat went in, along with about 1-2 cups of beef stock, 2 cans of coconut milk, and 2 whopping, heaping tablespoons of curry paste. Oh, and yea, 2 small handfulls of "blister" peanuts from Trader Joe's. Massaman is simply not complete without the peanuts, but TJ's has this brand made in the old fashioned way: soaked for a long time before roasting, the better way to ancestrally prepare legumes.

That spent an hour on high, and then from about 1pm until dinner at 7, on low.

The other things you need: onion sliced into wedges, white sweet potato, and carrots. You can add a bit of Thai fish sauce too, but I never bother. However, these things don't need to be added until the final hour of cooking. That way, they will still be firm, but tender.

Oh, yea, I had a smidgen of red bell pepper from the liver recipe the other day, so I chopped finely and put that in for some added color.

The rice is jasmine, i.e., Thai rice. For the 2 cups of dry rice, I used 2 cups of beef stock and 2 cups of water in the rice cooker.

...Well, it's just about time for lunch leftovers, as the rice cooker is still keeping the rice warm & ready and hot massaman curry is only a nuking away. So, if you'll excuse me...

Another post on Anarchy "at home and in your spare time"?is coming up later this afternoon, and I'm having a very fun time putting these together. ...Incidentally, no State was involved in the making of this dish.

Twelve months later, Herrin's cardiologist spotted the lump during a routine check-up.

"She said, 'You need to get a mammogram and ultrasound,'" said Herrin, who lives in Grovetown, Ga. "I said, 'I've been trying.'"

Two days after his 67th birthday, the results of the imaging tests and a biopsy were in. Herrin had breast cancer.

"I cried," he said. "It hit me so hard. That was the scariest moment in my life."

Herrin had a mastectomy, a breast-removing operation that left a long white scar where his nipple once was.

"It bothered me a lot to lose my breast," he said. "I wanted to be walking down the beach with my shirt off."

One in 1,000 men is diagnosed with breast cancer in his lifetime, according to 2012 data from the American Cancer Society. And the disease kills about one man every day in the United States.

"It's important to know that men are still at lower but measurable risk for breast cancer," said Dr. Marisa Weiss, president of Breastcancer.org. "It's not insignificant."

The lifetime risk of breast cancer in women is one in eight, but women are encouraged to check their breasts for changes and have mammograms as recommended. Men, on the other hand, often ignore the early signs of breast cancer, which include lumps in the breast, armpit or collarbone area, nipple discharge, and puckering, flaking or redness anywhere on the breast.

The American Cancer Society urges men to discuss any breast changes with their doctors. Once a breast cancer diagnosis is made, the treatments are similar for men and women and include surgery, radiation and chemotherapy. The survival rates are similar, too.

Herrin had no radiation or chemotherapy treatments after his surgery. But he does take the anti-estrogen drug tamoxifen to reduce the risk of the cancer's coming back.

"I never dreamed in a million years that I had breast cancer? There's not any cancer in my family," said Herrin, who has become an advocate for male breast cancer awareness.

"You need to go to a doctor," he said of men who ignore the signs. "You need to get checked. Because women are not the only ones who get breast cancer."

Texas executes man for 1991 stabbing-strangulation murder

AUSTIN, Texas (Reuters) - Texas prison officials on Wednesday executed a man for the gruesome 1991 murder a women who was stabbed repeatedly with an ice pick and strangled with stereo wire at her Dallas-area apartment, state officials said.

Bobby Lee Hines, aged 19 at the time of the killing, was sharing a next door apartment with a maintenance man who had master keys to all the units in the building, according to the Texas Department of Criminal Justice.

Hours after neighbors heard screaming and other loud noises coming from the apartment of Michelle Wendy Haupt, 26, her body was found just inside the door of her unit, covered with about 18 puncture wounds, according to a summary of the case from the Texas attorney general's office.

Hines' fingerprint and bloody palm print were found in the apartment. Haupt's gold sand-dollar charm was found in Hines' pants pocket.

Hines was put to death by lethal injection at a state prison in Huntsville, Texas. He was pronounced dead at 6:28 p.m. local time (2328 GMT), said Jason Clark, a spokesman for the criminal justice department.

Hines, 40, was the 11th person executed this year in Texas and the 33rd in the United States.

In his final statement, Hines asked Haupt's family for forgiveness, according to a copy of the statement provided by Clark.

"To the victim's family, I am sure I know that I took somebody special from y'all," Hines said. "I know it wasn't right, it was wrong."

He also said that God has forgiven him and that being locked up for the rest of his life would have been more of a punishment.

"I wish there was some other way to show I'm sorry," he said.

Hines' execution was scheduled for earlier this year, but it was postponed so that DNA testing could be conducted on fingernail clippings collected from Haupt's body. The testing did not exclude Hines as a source of the DNA, according to the attorney general's office.

Is obesity irreversible? Timing is key in weight loss

ScienceDaily (Oct. 24, 2012) ? Joint research between the University of Michigan and the Argentina-based National Council of Science and Technology (CONICET) has shed light on one of the most frustrating mysteries of weight loss -- why the weight inevitably comes back.

A novel animal model showed that the longer mice remained overweight, the more "irreversible" obesity became, according to the new study that appeared online ahead of print Oct.24 in the Journal of Clinical Investigation.

Over time, the static, obese state of the mice reset the "normal," body weight set point to become permanently elevated, despite dieting that initially worked to shed pounds, authors say.

"Our model demonstrates that obesity is in part a self-perpetuating disorder and the results further emphasize the importance of early intervention in childhood to try to prevent the condition whose effects can last a lifetime," says senior author Malcolm J. Low, M.D., Ph.D., professor of molecular and integrative physiology and internal medicine.

"Our new animal model will be useful in pinpointing the reasons why most adults find it exceedingly difficult to maintain meaningful weight loss from dieting and exercise alone."

The lead author of the study was Viviana F. Bumaschny, M.D., assistant investigator of CONICET.

Obesity affects more than 500 million adults and 43 million children younger than age 5, while related illnesses are the leading preventable cause of death.

Individuals who are overweight have a much higher risk of type 2 diabetes, hypertension, and cardiovascular diseases.

One of the major strengths of the research was a new model of obesity-programmed mice that allowed weight loss success to be tracked at different stages and ages by flipping a genetic switch that controls hunger.

Turning on the switch right after weaning prevented the mice from overeating and ever becoming obese. Similarly, mice that remained at a healthy weight into young adulthood by strict dieting alone were able to maintain normal weight without dieting after turning on the switch. However, chronically overfed mice with the earliest onset of obesity never completely returned to normal weight after flipping the switch, despite marked reduction in food intake and increased activity.

The new findings may raise questions about the long-term success rate of severe calorie restriction and strenuous exercise used later in life to lose weight, such as the extreme regimens seen in the popular reality television show "Biggest Loser."

"Somewhere along the way, if obesity is allowed to continue, the body appears to flip a switch that re-programs to a heavier set weight," Low says. "The exact mechanisms that cause this shift are still unknown and require much further study that will help us better understand why the regaining of weight seems almost unavoidable."

The findings will be published alongside a corresponding commentary "Tipping the scales early: probing the long-term effects of obesity."

To realize perfect coordination with your pony of the ?two bodies and one mind? class, you need to earn his trust. And a corporal approach will never earn that trust.

It could be hard work, nevertheless it is miles away from impossible. Your horse is bright enough to respond well if you?re intelligent enough to teach well, and all it desires is total patience and persistence from you.

I have heard people say you can train the ideal pony only when you get the right pony. Unless you?re talking about horses with incurable physical shortcomings, I personally believe every horse can be trained right. You cause the right disposition when you show the right approach.

New Jersey Division of Consumer Affairs Obtains $7.7 Million Judgment Against ?Roofing Police? Contractor Accused of Performing Shoddy Work and Deceiving Consumers

NEWARK ? Attorney General Jeffrey S. Chiesa and the New Jersey Division of Consumer Affairs today announced a $7.7 million judgment against John Kot, of Garwood, and his multiple home improvement companies ? including Roofing Police, Inc., which has used distinctive vehicles painted to resemble police squad cars. Under the terms of the judgment, Kot and the companies are permanently barred from performing home improvement work, and Kot is permanently barred from managing or owning any business in New Jersey.

?These defendants allegedly left consumers with shoddy work, broken promises, and warranties that were ignored ? often while using business names or language on their websites that implied they had some connection to government or police work,? Attorney General Jeffrey S. Chiesa said. ?We have held them accountable by obtaining a judgment that provides for consumer restitution and civil penalties, and which prohibits them from performing home improvement work, or even owning or managing any business in New Jersey.?

Under the Final Judgment by Default and Order, entered by Bergen County Superior Court Judge Robert P. Contillo, defendant Kot, 41, and the various home improvement companies he operated, were found to have engaged in conduct which comprises 1,542 violations of the State Consumer Fraud Act, Contractors? Registration Act, Contractor Registration Regulations, Home Improvement Regulations, and Advertising Regulations.

Kot and his companies are collectively required to pay a total of $7.7 million ? including $150,000 in consumer restitution, $7.5 million in civil penalties, $38,000 for the State?s attorney?s fees, and $30,000 for the State?s investigative costs. Kot and his companies are permanently enjoined from performing home improvements in the State. Kot also is permanently enjoined from managing or owning any business in the State; and the corporate charters of the defendant corporations and companies are annulled.

The Final Judgment by Default and Order is against all defendants in the State?s complaint, except for Gabriel R. DaSilva, Jr., who settled with the State via a Final Consent Judgment. A $30,000 civil penalty is assessed against DaSilva but will remain suspended so long as he complies with the terms of the settlement as well as all applicable laws. DaSilva is not barred from performing home improvement work, so long as he first obtains State registration as a home improvement contractor.

?Our investigation and the Court?s findings make it abundantly clear that consumers must be cautious when hiring a home improvement contractor,? Acting Director Eric T. Kanefsky said. ?Through this default judgment, we have ensured that one of the worst can no longer defraud New Jersey?s consumers.?

The State?s complaint, filed on behalf of the Division of Consumer Affairs by the Division of Law, alleged that the defendants performed substandard work; refused to repair their substandard work despite promises and/or warranties; refused to return consumer deposits for work that was never performed; failed to honor guarantees or warranties provided in their contracts; and started work without the necessary state or local permits. The companies also allegedly advertised through names and statements that wrongfully implied they were affiliated with government or were quasi-police agencies or police-affiliated businesses.

The State alleged that the defendants perpetuated their deceptive business practices through the interchangeable use of multiple business entities, names, addresses and phone numbers. Defendants advertised or contracted with consumers using the following corporations, limited liability companies, trade names and/or unregistered business names: A-1 American Construction, Inc.; A 1 American Chimney Limited Liability Company; Brick City Chimney Service, L.L.C.; Brick City Chimney Service and Cleaning, Inc.; Roofing Police, Inc.; Roofing Squad; Chimney Squad; Brick City; Brick City Chimney & Roofing Services; A-1 American Masonry; A-1 American Masonry Services; A-1 American Chimney Service; A-1 American Contracting; A-1 American Roofing; A-1 American Gutters; A-1 American Siding; A-1 Affordable Construction; A Above American; A Above Brick City; and Diamond Roofing. Defendants used common addresses in Fair Lawn, Hackensack, Maywood and Garwood. The State?s Complaint further alleged that the defendants misrepresented their business locations and, in Kot?s case, used as assumed name as an alias in the course of conducting business. The Division of Consumer Affairs received complaints about the defendants from a total of 81 consumers.

Deputy Attorney General Nicholas Kant, in the Division of Law?s Consumer Fraud Prosecution Section, represented the State in this action.

Before hiring a home improvement contractor, New Jersey consumers are urged to:

Obtain the contractor?s State registration number, which always begins ?13VH.?
Contact the Division of Consumer Affairs to learn whether the contractor?s registration is still valid. Call the Division?s License Verification Line at 973-273-8090, or check the Division?s database of all 43,000 registered home improvement contractors.
Demand a copy of the contractor?s commercial general liability insurance policy.
Contact the insurer to learn whether the policy is still valid.
Run Internet searches to see if there are online complaints against the contractor.

MADISON A new study shows that a blood marker is linked to pancreatic cancer, according to a study published today by scientists at the University of Wisconsin Carbone Cancer Center and Mayo Clinic.

First author Dr. Halcyon Skinner, assistant professor of population health sciences at the University of Wisconsin School of Medicine and Public Health, says the study is the first time pancreatic cancer risk has been linked to differences in telomeres' length in blood cells.

"This suggests a new avenue to identify those with pancreatic cancer or those at risk of developing the cancer in the future,'' he says.

Skinner's colleagues at Mayo Clinic took blood samples from more than 1,500 people 499 of them with a diagnosis of pancreatic cancer and 963 of them cancer-free control subjects. Specifically, the scientists were interested in the length of the telomeres the end caps on chromosomes found in white blood cells. They found a direct relationship with the risk of pancreatic cancer: the shorter the telomeres, the more likely a person was to have pancreatic cancer.

Telomeres maintain the stability of genes, and are known to shorten with age as cells divide. People of the same chronological age can have vastly different telomere lengths. In other words, some people's cells can by viewed as biologically older than cells from other people the same age.

"We know that people with many factors that are classically unhealthy also tend to have shorter telomeres. Those who have had stressful lives, exposed to chronic inflammation, have poor glucose control or smoked cigarettes tend to have shorter telomeres, and that can set the stage for genetic damage,'' Skinner explains.

Shortened telomeres in the blood have already been associated with other types of cancer, including colon cancer.

"We found the same relationship with pancreatic cancer, and for the vast majority of our participants, there was a direct linear relationship," he says, "the shorter the telomere, the higher the likelihood of pancreatic cancer."

But because shorter telomere length is also associated with the development of other cancers and other diseases of aging, measurement of telomere length alone is not a specific marker for pancreatic cancer.

Dr. Lisa A. Boardman, of Mayo Clinic, who led the overall study, says that future studies need to address if telomere length and other markers of pancreatic cancer should be combined to create a test that could be used clinically.

Skinner and UW colleagues Ron Gangnon and Kristin Litzelman led the design and data analysis of the study. It is being published in Cancer Epidemiology, Biomarkers and Prevention, a journal of the American Association for Cancer Research.
